Request for Payment of Outstanding Sewer and Water Charges from Proceeds of a Property Tax Sale

Municipalities can apply to be reimbursed for outstanding sewer and water charges when a property in their municipality is sold in a property tax sale.

Section 16(7) of the Real Property Tax Act R.S.P.E.I. 1988 sets out the priorities for the disbursement of proceeds from a tax sale of real property.  Municipalities are the fourth priority for the disbursement of the proceeds, provided they have certified the amount owing, and have completed and delivered the Request for Payment of Outstanding Sewer and Water Charges from the Proceeds of a Property Tax Sale form to the lawyer conducting the sale prior to the date of the property tax sale.

Municipalities should monitor the Royal Gazette and newspapers for advertisements of tax sales within their municipalities.
